Resumen : The present investigation intends that the surrogate motherhood is considered as a punishable act in the Ecuadorian legal system, since in this way it will be avoided that the rights of the children are violated. At present, in the Ecuadorian legal system surrogate motherhood is not regulated; Nevertheless in 2000 an attempt was made to create a draft Family Law, in which I try to regulate the application of surrogacy, but this bill was never promulgated. Although it is true the Ecuadorian legislation does not prohibit the realization of maternity surrogates, so it is understood that it is fully allowed, so it is now being carried out with total freedom, without any type of control. The reason for which the researcher has thought it appropriate to present the present investigation with the theme "Surrogate Motherhood and the Superior Interest of the Child", has the purpose of proposing the prohibition of surrogacy since its application constitutes a form of exploitation of women And above all makes children into commercial products. It therefore implies a flagrant violation of the rights of children. This means that in the Integrated Criminal Code, sanctions are established for those who apply this reproductive technique of surrogacy.
Descripción : La presente investigación pretende que la maternidad subrogada sea considerada como un acto punible en el ordenamiento jurídico ecuatoriano, ya que de este modo se evitará que los derechos de los niños sean violentados. En la actualidad en el ordenamiento jurídico ecuatoriano la maternidad subrogada no se encuentra normada; sin embargo de ello en el año 2000 se intentó crear un proyecto de Ley de Familia, en el que intento regular la aplicación de la maternidad subrogada, pero este proyecto de ley nunca fue promulgado. Si bien es cierto la Legislación ecuatoriana no prohíbe la realización de la maternidad subrogaba por lo que se sobreentiende que está se encuentra plenamente permitida, por lo que en la actualidad se la viene realizando con total libertad, sin ningún tipo de control. Motivo por el cual la investigadora ha creído conveniente plantear la presente investigación con el tema “La Maternidad Subrogada y el Interés Superior del Niño”, tiene como finalidad proponer la prohibición de la maternidad subrogada ya que su aplicación constituye una forma de explotación de la mujer y sobretodo convierte a los niños en productos comerciales. Supone, por tanto, una flagrante violación de los derechos de los niños. Esto significa que en el Código Orgánico Integral Penal, se establezca sanciones para quien aplique esta técnica reproductiva de la maternidad subrogada.
