Zusammenfassung: The present investigative work has its origin in the cases of massive decoupling of police servers in the Republic of Ecuador through ministerial agreements issued by the Ministry of the Interior, a subject that is booming within the country since the so-called "30S". During its development, Ministerial Agreement 4421 was analyzed, which resolves to unlink 322 police officers at the national level, who suffered violations of their constitutional and labor rights during this process, currently seeking to reinsert immediately those persons who were disengaged without no reason The Constitution of the Republic of Ecuador in its Art.76, numeral 7, literal L establishes that "the resolutions of the public powers must be motivated", which allows to explain that if a resolution does not state the legal principles in which it is based there can not be a proper motivation.
Beschreibung: El presente trabajo investigativo tiene su origen en los casos de desvinculación masiva de servidores policiales en la República del Ecuador mediante acuerdos ministeriales emitidos por el Ministerio del Interior , un tema que se encuentra en auge dentro del país desde el denominado “30S”. Durante su desarrollo, se analizó el Acuerdo Ministerial 4421, que resuelve desvincular a 322 servidores policiales a nivel nacional, mismos que sufrieron violaciones a sus derechos constitucionales y laborales durante este proceso, actualmente se busca reinsertar de manera inmediata a aquellas personas que fueron desvinculadas sin motivo alguno. La Constitución de la República del Ecuador en su Art.76, numeral 7, literal L establece que “las resoluciones de los poderes públicos deberán ser motivadas”, lo que permite explicar que si en una resolución no se enuncian los principios jurídicos en los cuales se fundamenta la misma no puede existir una debida motivación.
