Item El aborto en mujeres con discapacidad mental víctimas de violación y el derecho a la vida(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2017-05) Flores Tamayo, Nelson Mauricio; Pazmiño Vargas, Klever AlonsoThis research, entitled "ABORTION IN WOMEN WITH MENTAL DISABILITY, VICTIMS OF VIOLATION AND THE RIGHT TO LIFE," proposes that the degree of mental disability of a woman victim of rape should be considered to contemplate abortion as a non-punishable act. Currently under Ecuadorian legislation, abortion is sanctioned; however, there are certain exceptions such as when a woman with a mental disability is violated, abortion is permitted; Thus violating the right to inviolability of life, contemplated in the Constitution of the Republic of Ecuador. In addition, allowing women with non-severe mental disabilities, who have been victims of rape, to perform an abortion, constitutes a total and absolute violation of the right to life that the human being has. This permissive and generalized action within the Ecuadorian criminal law against abortion of women with mental disabilities contravenes the provisions of the Constitution of the Republic with respect to life itself. To ensure an adequate and effective administration of justice in terms of establishing the criminal responsibility of women with mental disabilities who have been victims of rape and who end up with the life of the being in their womb, it is necessary to establish the degree of mental disability they suffer. This type of abortion should be a punishable act that inevitably entails a sanction for these women and consequently a decrease of the mortality rate for this cause.Item El Derecho a la vida y el aborto: análisis comparativo entre la legislación Ecuatoriana y la legislación Argentina(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-02) Quezada Paredes, Yanira Madeleine; Espín Meléndez, María CristinaThe right to life in the Republic of Ecuador is a right that is protected and guaranteed in the Ecuadorian legal system, which allows human beings to exercise fundamental rights due to their importance and being protected by law. No one can be arbitrarily deprived of life. However, there is an issue that directly affects this right, and that is abortion, which is widely debated in society. Opinions are divided: some are in favor and others against, but we must base our views on the law. Additionally, by expanding our research and focus, analyzing different regulations and a society that is more open, like Argentina, in relation to the right to abortion compared to the Ecuadorian regulations, through doctrine, laws, and jurisprudence, we can give way to different approaches. Even in Ecuadorian society, it continues to be a taboo, such as sexual freedom and the right to decide over one's body based on human dignity, physical, sexual, psychological integrity, health, autonomy, and privacy, which are enshrined in the catalog of rights of both legislationsItem La Falta de Aplicación del Art 444 del Código Penal en donde se sanciona la realización del Aborto de manera voluntaria, vulnera los Derechos de Protección del Nasciturus, en la Cuidad de Ambato en el primer trimestre del año 2010.(2010) Quishpe Chérrez, Lucía ElizabethTiene como objetivo general la creación de una Unidad Especializada de Investigación de Delitos de Aborto, la cual se encargará de difundir la sanción establecida en el Código Penala fin de que la sociedad en general concientice y sepa de la obligación que tienen de denunciar a las mujeres que se someten a esta práctica, para que éstas sean sancionadas, y además de investigar los lugares en los cuales se realiza los abortos de menra clandestina y se sancione a los responsables de éstas.Con esta Unidad el índice de abortos de manera manera voluntaria y los lugares clandestinos dentro de la ciudad de Ambato dismunuirán, ya sea por la concientización de la sociedad como por el temor a ser denunciadas en el caso de las mujeres que se someten voluntariamente a ésta práctica.
