Abstract
The purpose of this investigative work is to analyze the jurisdictional guarantees of Protective Action
recognized in the Constitution of the Republic of Ecuador and their respective influence on the
exercise of the rights to higher education. For the development of the same mechanism, a type of
qualitative and quantitative quality methodology has been applied with an approach focused on the
scope of description. With the objectives of collecting and obtaining reliable data, bases, techniques
and tools were applied, such as surveys and the respective case study, given the scope of the nature
of the study. Once the corresponding and respective measures of the methodology scope have been
applied, a conclusion is reached that one of the most important legal resources that the legal
regulatory scope of the Ecuadorian State has to guarantee the protection of constitutional rights is the
protection action, especially the right to higher education, since the importance of these jurisdictional
guarantees in the field of the right to higher education in Ecuador lies in their ability to provide legal
security and create favorable conditions for the academic and professional growth of students.

discrimination in any of its forms, these types of guarantees contribute to the development of a more
just society with the freedom to access higher education, this being a tool for evolution.
Both the right and the guarantee offered by the legal system in a society show that these two tools
have a correlation for their exercise and in Ecuador this is applied when there is a violation of any
right previously established in the Constitution.
Description
El presente trabajo de ámbito tipo investigativo tiene como finalidad el análisis de las
garantías de tipo jurisdiccional de Acción de Protección reconocida en la Constitución de
la República del Ecuador y su respectiva influencia en el ejercicio de los derechos a la
educación superior. Para el desarrollo del mismo mecanismo se ha aplicado un tipo de
metodología de calidad cualitativa y cuantitativa con un enfoque centrado en el ámbito
de descripción. Con los objetivos de recolección y de obtener datos de tipo confiables se
aplicaron bases, técnicas y herramientas como son las encuestas y el respectivo estudio
de casos, esto dado el ámbito de la naturaleza del estudio. Una vez aplicadas las
correspondientes y respectivas medidas de ámbito de metodología se llega a una
conclusión que de los recursos legales más importantes que tiene el ámbito de tipo
normativo legal en el Estado Ecuatoriano para la garantía de protección de derechos
constitucionales es la acción de protección, en especial el derecho a la educación superior,
ya que la importancia de estas garantías jurisdiccionales en el ámbito del derecho a la
educación superior en el Ecuador, radica en su capacidad de brindar seguridad jurídica y
crear condiciones favorables para el crecimiento académico y profesional de los individuos.
Además, al fomentar la equidad de oportunidades y prevenir en cualquiera de sus formas el
abuso o discriminación, este tipo de garantías aportan al desarrollo de una sociedad más justa
con libertad de acceder a la educación superior siendo esta una herramienta para la evolución.
Tanto el derecho como la garantía que ofrece el ordenamiento jurídico en una sociedad da a
relucir que estas dos herramientas tienen una correlación para el ejercicio de las mismas y en
el Ecuador esta se aplica cuando existe vulneración de algún derecho establecido previamente
en la Constitución.
