    La acción extraordinaria de protección y la tutela judicial efectiva en derechos constitucionales en el Ecuador

    Under the principle that Ecuador is a Constitutional State of Rights and Justice, a wide range of principles and guarantees have been positivized in its 2008 Constitution. Among them is the Extraordinary Action of Protection, as a jurisdictional guarantee available to citizens, whose purpose is the protection of fundamental rights, when they have been violated in a final decision by an administrator of justice. However, at present, the statistics of the Constitutional Court of Ecuador reflect a high rate of inadmissibility of the demand for this action, which poses a risk to effective judicial protection in guaranteeing access to justice. The importance of this research work lies in identifying the factors that lead to this problem; since the inadmissibility of this action would imply the violation of a constitutional right and therefore of related rights, violating legal certainty. In response to this problem, the aim is to explain in a clear manner the legal assumptions suitable for the substantiation of this jurisdictional guarantee, promoting its correct use. To carry out this task, methodologically, explanatory research has been used, with quantitative, qualitative and inductive approaches; relying on the documentary technique and observation for the adequate and coherent collection of information from primary and secondary sources. Approaches and techniques that provide the researcher with the necessary arguments to explain the cause-effect relationship of the problem based on a hypothesis. This work is framed within the research line: public policies, law and society; and includes statistics and recent jurisprudence that favors the correct use of the Extraordinary Protection Action

    El abandono por inasistencia de la parte actora a las audiencias y la tutela eficaz de los derechos

    Currently the General Organic Code of Processes is in force since May 2016, norm that regulates the procedural and pre-procedural aspects of civil proceedings, except for matters such as electoral, criminal and constitutional. The General Organic Code of Processes is the norm for the processing of trials in labor, family, tax and administrative litigation, and civil matters; regulating several aspects that were not previously regulated by the previous civil procedure legislation, such as the way of conducting the audiences, which must comply with several principles such as: publicity, procedural loyalty, orality, immediacy. The General Organic Code of Processes, says that there are several extraordinary ways to end a process including conciliation, retirement of demand, withdrawal, trespassing and abandonment. In accordance with the principle of orality enshrined in the Republic Constitution, all processes are governed by the oral system and the judges listens to the parties, the parties practice all proofs, the judge makes the oral statement and reasoned resolution. Currently article 87 of the General Organic Code of Processes, stipulates the effects of the lack of appearance to the audiences, stating in numeral 1 that when the applicant did not appear at the corresponding audience, his absence will be as abandonment; it is worth mentioning that the rule cited in Art. 249 shows us the effects of abandonment, among them, if the abandonment of the first instance is declared, no new claim can be filed. There may be several factors of force majeure for which the actor could not attend an audience among them who pass the following circumstances on that day such as: illness, domestic calamity, mechanical damage of the medium used by the actor to attend the audience. Our Republic Constitution in her articule 75 establishes the effective protection of rights and upon declaring abandonment, the plaintiff will not be able to file a new claim in the first instance, remaining defenseless because he can not exercise the rights that he is assisted.

    The present investigation is based on the need not only to guarantee the principles and constitutional rights of the people who have been apprehended in flagrante delicto, but also through a legal reform that allows those involved to have unrestricted access to said rights. In order to be aware and in this way consistent with the research work, you will always have to start from the regulations contained in the Constitution of the Republic of Ecuador of 2008, as the supreme rule, as you always have to take into account what provides for Art. 424, where the Constitution prevails over any other of the legal system, and in the case of human rights, With regard to the International Treaties and Conventions ratified by Ecuador, it must be taken into account that the same when dealing with human rights that have more preferential situations for people, they are on the Constitution, even if they are not established within the Constitution. of its regulations. The Right to Defense is the basis of this work, because its main objective is the legal protection of rights, which can´t be violated by justice operators. It should not be forgotten that fundamental rights are born with modern constitutions.

    the current research work is aimed at the “ right of adolescent offenders and competence of judges of childhood and adolescence ”, which analyzes the criminal responsibility of juvenile delinquents , will be subject to the , norms indicated in the organic code of children and Adolescents , that allows the application of socioeducational measures , which are protectionist of adolescents; but harmful to society , since we know that minors are considered as a group , of double vulnerability since most of the cases are used to commit crimes . for which the increase of crime in our country committrd by adolescents that is considered a crime punishable by the unlawful acts committed, with sanctions of more than ten years as established in the penal code, for the reason that the law allows them to exercise a rigorous sanction but, must be exercise by a court of judges specializing in juvenile offenders since they must study all ; the causes that led him to commit a crime that is . They must be punished responsible for the crimes committed, in this thesis. I demonstrate that the sanctions imposed on juvenile offenders are based on socio-educational measures that are administered by a judge of the childhood and Adolescence, accordance with the regulations established in the code of children and adolescents; such as: reprimand 5 and imposition of rules of conduct, counseling and family support. repair of damage caused, community services assisted freedom, home detection internment during the weekend, internment of the semifreedom internment; which means that teenagers who commit crimes after having committed a serious crime, with the application of socio –educational measure, continue in the regularity of criminal acts and not achieve social rehabilitation of the adolescent offender, are also protected and guaranteed rights. situations that is used to continue in criminal .acts to be considered unimputable subjects therefore , it is imperative to request the creation of specialized courts that have a knowledge of the most infringing offenders , since nowadays minors are punished by the same judge who takes all the procedural stages without doing a thorough study of the procces , on the incomputability of juvenily delinquents, thus guaranteeing citizens security , in the theoretical and field work of this thesis I was able to obtain criteria with clear and precise grounds , the same ones that helped me verify objectives and contrast hypotheses , which allows me to strengthen the proposed

    La concurrencia de la responsabilidad penal y el sobreseimiento

    This investigation is based on the fact that it is not only aimed at guaranteeing principles, guarantees and constitutional rights that are established both in the Constitution of the Republic of Ecuador, and in the Comprehensive Organic Criminal Code, what is sought is that through a legal reform to accede without restrictions to these principles, guarantees and rights. To be consistent with the present investigative work is always part of the provisions of the Constitution of the Republic of Ecuador of 2008, as the supreme rule, which has constitutional supremacy over any other law, then focus on the International Treaties and Agreements ratified by Ecuador, with the only exception that the same when dealing with human rights are even on the Constitution. The Right to Judicial Protection, comes to make the paradigm of this work, because its main objective is the legal protection of rights, which can not be violated by justice operators.     Incumplimiento del estado y la vulneración del derecho a la seguridad social de las personas privadas de libertad

    This research is based on that is not aimed only at ensuring constitutional principles and rights of third people through the process. Basically, it looks for a legal reform that helps us to access to those unrestricted rights. To be consistent with the research work we always start with the provisions of the Republic Constitution, as the supreme rule, which has Supremacy Constitutional over any other law, then we focus on the International treaties and conventions ratified by Ecuador, with the only exception that the same human rights to be treated are inclusive over of our Constitution. The Judicial Protection Right becomes the paradigm of this work, because it has as its primary objective the legal protection of rights, which cannot be violated by judges. We should not forget that fundamental rights are born with modern constitutions.

    El proceso arbitral y el derecho a la tutela judicial efectiva de terceros

    Esta investigación se fundamenta en que no está encaminada solamente a garantizar principios y derechos constitucionales de terceros dentro del proceso arbitral, sino también que a través de una reforma legal acceder sin restricciones a dichos derechos, haciendoce a respetar la tutela judicial efectiva estipulada en nuestra Constitución. Derecho que ampara a todos los ecuatorianos y extrajeros que habiten en nuestro país. Para ser congruentes con mi trabajo investigativo siempre partí de las disposiciones de la Constitución de la República, como norma suprema, la misma que tiene Supremacía Constitucional sobre cualquier otra ley, para luego enfocarnos en los Tratados y Convenios Internacionales ratificados por el Ecuador, con la única salvedad que los mismos al tratarse sobre derechos humanos inclusive están sobre nuestra Constitución. Posterior se hace referencia al Código Orgánico de la Función Judicial, por cuanto el mismo controla el aparataje judicial contando con la Corte Constitucional que es el organismo encargado de resolver sobre la inconstitucionalidad de cualquier ley y aclarando que sus fallos son vinculantes y si un funcionario judicial no acta los mismos es destituido de su cargo. Por último se hace referencia a la Ley de Arbitraje y Mediación, que ha servido de base para este trabajo, cuyo fin es llegar a acuerdos entre las partes de una manera ágil, para así evitar que las partes acudan al sistema judicial. El Derecho a la Tutela Judicial, viene hacer el paradigma del presente trabajo, porque tiene como objetivo primordial la protección jurídica de los derechos, los mismos que no pueden ser vulnerados por los jueces. No se debe olvidar que los derechos fundamentales nacen con las constituciones modernas.
